Rental agreement

Version 2, published Sun 11 Oct 2026. You'll be asked to accept it when you book.

VACATION RENTAL AGREEMENT This agreement is between the owner of Sleepy Marmot Whistler ("we", "us") and the person who books the stay ("you"). It covers your stay at Unit 89, 4335 Northlands Boulevard, Whistler, British Columbia (the "Property"), including its furnishings, linens, kitchenware and hot tub, and the parking and common areas guests may use. The exact unit and arrival details are sent to you before check-in. By typing your full name and ticking "I agree" when you book, you sign this agreement electronically, for yourself and everyone staying with you. We keep a record of the name you typed, the date and time, and the IP address it was sent from. Your booking request, our acceptance and your booking confirmation (dates, guests and prices) form part of this agreement, along with the house rules and policies on our website. 1. BOOKING AND PAYMENT - Booking is by request. When you request, your card is authorized but not charged. If we don't accept within the time shown when you book, the hold is released and nothing is charged. - When we accept, 50% of the total is charged as a deposit. The balance is charged automatically to the same card 30 days before check-in. If you book within 30 days of check-in, the full amount is charged when we accept. - Prices are in Canadian dollars and include the cleaning fee, GST, PST and the Municipal and Regional District Tax. - If the balance can't be charged, we'll email you a link to pay it. If it stays unpaid, we may cancel the booking, and the cancellation terms in section 3 apply. - You authorize us to charge the card you booked with for the deposit, the balance, and any amounts owed under section 6. 2. CHECK-IN, CHECK-OUT AND MINIMUM STAY - Check-in is from 4:00 p.m. on your arrival date. Check-out is by 11:00 a.m. on your departure date. - Early check-in or late check-out is only by arrangement with us in advance. Staying past check-out without our agreement may be charged as an extra night. - Minimum stays vary by date and are shown when you book. 3. CANCELLATIONS AND CHANGES If you cancel, we refund the amount you've paid as follows: - 30 or more days before check-in: 100% refund. - 14 to 29 days before check-in: 50% refund. - Fewer than 14 days before check-in: no refund. Cancelling a request we haven't accepted yet simply releases the hold on your card. Refunds go back to the card you paid with and can take 5 to 10 business days to appear. To change your dates or the number of guests, use "Request a change" on your booking page. Changes depend on availability, are priced at the current rates, and only take effect once we approve them. If we have to cancel (for example because the Property is damaged or unsafe), we will refund everything you've paid. Our responsibility is limited to that refund. No refund is given for leaving early, or for things outside our control such as weather, road or highway closures, ski lift or mountain conditions, or interruptions to power, internet or local services. We strongly recommend travel insurance that covers cancellation and interruption. 4. OCCUPANCY - No more than 8 people may stay overnight, including children. Only the guests in your booking may stay. - Parties and events are not allowed. - You must be at least 18 years old, and you must be one of the guests staying at the Property. 5. HOUSE RULES You agree to follow the house rules published on our website, and to make sure everyone in your party and anyone you invite does too. In particular: - No smoking or vaping anywhere in the unit, on the decks or patios, or on the complex's common property. - No pets. - Quiet hours are 10:00 p.m. to 8:00 a.m. The hot tub may not be used after 10:00 p.m., under the complex bylaws. - Respect the neighbours: the Property is in a residential strata complex. The house rules list the fines that apply. If a rule is seriously broken (for example a party, more guests than allowed, illegal activity, or behaviour that puts people or the Property at risk), we may ask everyone to leave without a refund. 6. DAMAGE, CLEANING AND FINES - Please tell us straight away if anything is damaged, missing or not clean when you arrive, or if something breaks during your stay. - You are responsible for: - damage to the Property or its contents caused during your stay, beyond normal wear and tear; - cleaning beyond normal turnover cleaning; - lost keys, fobs or parking passes; - fines charged to us by the strata or the Resort Municipality of Whistler because of your party's behaviour (for example noise, smoking, pets or hot tub use after hours). - We'll tell you within 14 days after check-out if we intend to charge you for any of these, and send photos, receipts or the fine notice. You authorize us to charge the card you booked with, up to the damage limit shown when you book. You remain responsible for any amount above that limit. 7. HOT TUB AND SAFETY - The hot tub is used at your own risk. Supervise children at all times. Don't use it under the influence of alcohol or drugs, and don't sit on the cover. - Report any safety concern to us right away. - Winter tires are required by law on the Sea-to-Sky Highway from October 1 to March 31. 8. ACCESS We, or people working for us, may enter the Property during your stay for repairs, maintenance or inspection with at least 24 hours' notice, or without notice in an emergency. 9. RESPONSIBILITY To the extent the law allows, we are not responsible for injury, loss, theft or damage to you, your party or your belongings during the stay, except where caused by our negligence. Please don't leave valuables in vehicles. 10. GENERAL - This is a vacation rental for travel accommodation, not a tenancy. The Residential Tenancy Act does not apply. - We handle your personal information as described in our privacy policy. - This agreement is governed by the laws of British Columbia. - If any part of this agreement can't be enforced, the rest still applies.
